Deferred Prosecution is a legal program in Washington State that allows eligible individuals charged with offenses related to substance use, mental health, or behavioral concerns to receive treatment instead of moving directly through the traditional court process.Â
Deferred Prosecution is most commonly used in DUI and other alcohol- or drug-related driving offenses. The program is authorized through Washington State law and is designed for individuals who acknowledge that their condition contributed to the offense and are willing to participate in treatment.
When a person is accepted into Deferred Prosecution, the court places the criminal case on hold while the individual completes a structured treatment plan. In many cases, this includes:
A comprehensive assessment
Substance use disorder or mental health treatment
Ongoing monitoring and compliance requirements
Abstinence from alcohol and non-prescribed substances
Attendance at required court hearings and follow-up appointments
